Procurement
is an ever-changing marketplace where the policy or
initiative of today becomes the process or procedure
of tomorrow.
European
Court of Justice rulings, Office of Government Commerce
guidance, legal cases and judgments all impact on the
methodologies that procurement departments must employ.
This seminar will look at a variety of different issues
currently affecting procurement, as well as examining
the current processes which are designed to ensure best
practice.
Effective
procurement can only be guaranteed when those charged
with the task have access to the latest procurement
guidances and an understanding of European and UK case
law.
This
seminar will look at the latest judgments on the use
of selection criteria, such as ‘Lianakis’,
and will consider the impact of past cases such as ‘Beentjes’.
The
latest guidance on competitive dialogue and framework
contracts will also be reviewed and some issues of concern
identified.
The
day will also identify which conditions constitute award
criteria and explain the difference between award and
selection criteria, as well as considering some often
overlooked contract issues such as novation. It will
finish with a review of suppliers’ rights, particularly
in respect of the forthcoming revised Remedies Directive.
